Social Sign in and the Terms of Servce (TOS) agreement

When visitors join my network with social sign in, they are taken straight to their new account settings page without seeing the TOS statement and checkbox that are revealed during the JR native signup process. This leads to at least two questions:

1) What are the legal implications?

2) What is the best way to guide social sign in members to the TOS statement and checkbox?

Some sites do not force the users to check a checkbox, they just have a privacy policy page and a Terms of Service page which ready "by using this site you agree.......".

When a user signs in they should hit that Agree page, if they are missing it by going via the social signup then that needs fixing, we'll get it fixed.

Just logged in to your site with Twitter and landed on the TERMS OF SERVICE (TOS) AGREEMENT. Could not get around not-checking that checkbox to continue.
